Transportation.
AB802,1,2 1An Act to amend 347.50 (3) (a) of the statutes; relating to: transporting a child
2in a child safety restraint system and providing a penalty.
Analysis by the Legislative Reference Bureau
Under current law, no person may transport a child under the age of 4 years old
in a motor vehicle unless the child is properly restrained in an approved child safety
seat. A person who violates this prohibition may be required to forfeit not less than
$30 nor more than $75. No forfeiture may be assessed if the vehicle was not equipped
with a child safety seat at the time of the violation and the person provides proof
within 30 days after the violation that the vehicle has been properly equipped with
an approved child safety seat.
Under this bill, a person who violates this prohibition is required to forfeit $100
for a first violation and $250 for each subsequent violation committed within 3 years.
The bill does not change the exception to the forfeiture described above.
