AB818,1,2 1An Act to amend 134.66 (4) (a) 1.; and to create 134.66 (2) (f) of the statutes;
2relating to: the sale of cigarettes and tobacco products and providing a penalty.
Analysis by the Legislative Reference Bureau
This bill prohibits a person who sells tobacco products, including cigarettes,
from offering them for sale in a manner that results in their being directly accessible
to the public. The bill also requires that a person selling tobacco products assist the
purchaser in obtaining the product.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB818, s. 1 3Section 1. 134.66 (2) (f) of the statutes is created to read:
AB818,1,54 134.66 (2) (f) 1. No retailer may offer for sale cigarettes or tobacco products in
5a manner that results in their being directly accessible to the public.
AB818,1,96 2. No retailer or his or her employe or agent may sell, exchange, barter, dispose
7of or give away cigarettes or tobacco products to another person unless the retailer
8or his or her employe or agent assists that person in obtaining the cigarettes or
9tobacco products.
AB818,1,1110 3. Subdivisions 1. and 2. do not apply to the sale of cigarettes from vending
11machines.

1Section 2. 134.66 (4) (a) 1. of the statutes is amended to read:
AB818,2,42 134.66 (4) (a) 1. In this paragraph, "violation" means a violation of sub. (2) (a),
3(c), (cm), (d) or, (e) or (f) 1. or 2. or a local ordinance which strictly conforms to sub.
4(2) (a), (c), (cm), (d) or, (e) or (f) 1. or 2.
