AB859,1,4 An Act to amend 20.370 (5) (aw), 23.0955 (2) (a) (intro.), 23.0955 (2) (b) (intro.) and 23.0955 (2) (b) 3.; and to create 23.0955 (2) (am) of the statutes; relating to: grants for nonprofit conservation organizations and making an appropriation.

Analysis by the Legislative Reference Bureau

Current law requires the department of natural resources (DNR) to provide a one-time grant in the 1993-95 fiscal biennium to a nonstock, nonprofit corporation organized in Wisconsin to help groups to create nonprofit conservation organizations and to provide technical assistance to those organizations in certain areas such as management, real estate transactions and receiving federal income tax exemptions. The corporation must provide $25,000 in matching funds.

This bill requires that DNR make another such grant of $75,000 in fiscal year 1996-97 to such a corporation. The bill also authorizes DNR to make such a grant on an annual basis beginning in fiscal year 1997-98.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB859, s. 1 Section 1. 20.370 (5) (aw) of the statutes, as affected by 1995 Wisconsin Act 27, is amended to read:

AB859,2,5 20.370 (5) (aw) (title) Resource aids — nonprofit conservation organizations; Minnesota-Wisconsin boundary area commission. Biennially As a continuing appropriation, the amounts in the schedule for a grant to a nonstock, nonprofit corporation under s. 23.0955 (2) and for a payment to the Minnesota-Wisconsin boundary area commission under 1993 Wisconsin Act 343, section 24 (1). No moneys may be encumbered from the appropriation under this paragraph after June 30, 1995 for assistance to nonprofit conservation organizations under s. 23.0955.

AB859, s. 2 Section 2. 23.0955 (2) (a) (intro.) of the statutes is amended to read:

AB859,2,10 23.0955 (2) (a) (intro.) The department shall provide one grant of $75,000 in the 1993-95 fiscal biennium fiscal year 1996-97 to a nonstock, nonprofit corporation that is described under section 501 (c) (3) or (4) of the internal revenue code and organized in this state if the corporation meets all of the following requirements:

AB859, s. 3 Section 3. 23.0955 (2) (am) of the statutes is created to read:

AB859,2,14 23.0955 (2) (am) Beginning in fiscal year 1997-98, the department may provide an annual grant to a nonstock, nonprofit corporation that meets all of the qualifications under par. (a).

AB859, s. 4 Section 4. 23.0955 (2) (b) (intro.) of the statutes is amended to read:

AB859,2,17 23.0955 (2) (b) (intro.) The A corporation receiving the a grant under this subsection shall do all of the following:

AB859, s. 5 Section 5. 23.0955 (2) (b) 3. of the statutes is amended to read:

AB859,2,20 23.0955 (2) (b) 3. Conduct, with the assistance of the department, a conference in the 1993-95 fiscal biennium conferences on the topics specified in subd. 2.

AB859, s. 6 Section 6. Appropriation changes.

AB859,3,2 (1) In the schedule under section 20.005 (3) of the statutes for the appropriation to the department of natural resources under section 20.370 (5) (aw) of the statutes, as affected by the acts of 1995, the dollar amount is increased by $75,000 for fiscal year 1996-97 to provide funding for the grant required under section 23.0955 (2) (a) of the statutes, as affected by this act.

AB859, s. 7 Section 7. Effective date.

AB859,3,5 (1) This act takes effect on July 1, 1996, or on the day after publication, whichever is later.
