AB887,1,2 1An Act to amend 13.123 (1) (a) 1. and (c) of the statutes; relating to: a limitation
2upon the payment of legislative per diem allowances.

Currently, each member of the legislature who must establish a temporary
residence at the state capital for the period of any regular or special session is entitled
to an allowance for food and lodging expenses for each day that the member is in
Madison on legislative business, but not including Saturday or Sunday unless the
member is in actual attendance on that day at a session or meeting of a standing
committee of which he or she is a member. A member who does not establish a
temporary residence is entitled to one-half the daily allowance payable to members
who establish a temporary residence. The allowance is not payable for more than 30
days during a recess of the legislature unless otherwise provided by joint resolution.
This bill provides, in addition, that no member may receive the allowance for
more than 150 days in any calendar year.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB887, s. 1 3Section 1. 13.123 (1) (a) 1. and (c) of the statutes are amended to read:
AB887,2,114 13.123 (1) (a) 1. Any member of the legislature who has signified, by affidavit
5filed with the department of administration, the necessity of establishing a
6temporary residence at the state capital for the period of any regular or special

1legislative session shall be entitled to an allowance for expenses incurred for food and
2lodging for each day that he or she is in Madison on legislative business, but not
3exceeding 150 days in any year, and
not including any Saturday or Sunday unless
4the legislator is in actual attendance on such day at a session of the legislature or a
5meeting of a standing committee of which the legislator is a member. The amount
6of the allowance shall be established under s. 20.916 (8). Each legislator shall file
7an affidavit with the chief clerk of his or her house certifying the specific dollar
8amount within the authorized allowance the member wishes to receive. Such
9affidavit, when filed, shall remain in effect for the biennial session, except that a new
10affidavit may be filed for any month following an adjustment in the amount of the
11authorized allowance under s. 20.916 (8).
AB887,2,2012 (c) Each member shall certify to the chief clerk of the house in which the
13member serves, as promptly as may be following the 1st of each month, the number
14of days during the previous calendar month on which the member was in Madison
15on legislative business and for which the member seeks the allowance provided by
16this subsection. Such allowances shall be paid from the appropriation under s.
1720.765 (1) (a) or (b) within one week after each calendar month; and shall be paid,
18upon the filing with the department of administration, the chief clerk's affidavit
19stating the number of days in Madison on legislative business, not exceeding 150
20days in any year,
for all members each member of the chief clerk's house.

AB887,2,23 22(1) This act first applies beginning with the month following the month in
23which this act takes effect.
