AB900,1,4 An Act to amend 59.97 (4d) (title), 60.61 (3c) (title) and 62.23 (7) (he) (title); and to create 59.97 (4dm), 60.61 (3d) and 62.23 (7) (hf) of the statutes; relating to: the regulation of certain amateur radio antennas by cities, villages, towns and counties.

This bill restricts the ability of counties, cities, towns and villages (a political subdivision) to regulate the placement, screening or height of amateur radio anten nas. Under the bill, a political subdivision may not enact an ordinance or adopt a resolution on or after the effective date of the bill, or continue to enforce an ordinance or resolution on or after the effective date of the bill, that involves the placement, screening or height of amateur radio antennas unless the ordinance or resolution is reasonably crafted to address a specific health or safety concern. Under the bill a political subdivision may not enact an ordinance or adopt a resolution, or continue to enforce an ordinance or resolution, after the effective date of the bill, if the ordi nance or resolution is based solely on aesthetic considerations.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB900, s. 1 Section 1. 59.97 (4d) (title) of the statutes is amended to read:

AB900,1,6 59.97 (4d) (title) Antenna Satellite antenna facilities.

AB900, s. 2 Section 2. 59.97 (4dm) of the statutes is created to read:

AB900,2,11 59.97 (4dm) Amateur radio antenna facilities. The board may not enact an ordinance or adopt a resolution on or after the effective date of this subsection .... [re visor inserts date], or continue to enforce an ordinance or resolution on or after the effective date of this subsection .... [revisor inserts date], that involves the placement, screening or height of amateur radio antennas unless the ordinance or resolution is reasonably crafted to address a specific health or safety concern. AB900,3,14 62.23 (7) (hf) Amateur radio antenna facilities. The governing body of a city may not enact an ordinance or adopt a resolution on or after the effective date of this paragraph .... [revisor inserts date], or continue to enforce an ordinance or resolution on or after the effective date of this paragraph .... [revisor inserts date], that involves the placement, screening or height of amateur radio antennas unless the ordinance or resolution is reasonably crafted to address a specific health or safety concern.
