AB958,1,2 1An Act to amend 98.21 (1) and 98.21 (3) of the statutes; relating to: the sale of
2loaves of bread by weight.
Analysis by the Legislative Reference Bureau
Under current law, the weight of a loaf of bread sold in this state must be a
multiple of at least 4 ounces and must weigh at least one-half pound. This bill
eliminates these specific requirements so that a loaf of bread need only be sold by
weight.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB958, s. 1 3Section 1. 98.21 (1) of the statutes is amended to read:
AB958,2,44 98.21 (1) Except as provided in sub. (2), the weight of a loaf of bread
5manufactured, procured, made or kept for sale, offered for sale, or sold, for use or
6consumption within this state, shall be a multiple of 4 ounces and at least one-half
7pound avoirdupois
sold by weight. A variation or tolerance of one ounce in excess or
8not more than one ounce in deficiency per pound from the weights provided for in this
9section
shall be allowed in the weight of individual loaves of bread, but the average
10weight of at least 10 loaves of any one size shall not be less than the standard weight

declared weight on the label, tag or sign representing the

. If 10 loaves of the same approximate size are not available, then
3the weight of all available loaves shall be used to decide the average weight, but in
4no case shall said number be less than 5.

AB958,2,126 98.21 (3) No person, by himself or herself or by a servant or agent, no firm or
7corporation, in its own behalf or by a servant or agent, and no person, firm or
8corporation as the servant or agent of another person, firm or corporation, shall
9manufacture, procure, make or keep for sale, offer or expose for sale, or sell, bread
10in the form of loaves of weights other than provided for in sub. (1) and in excess of
11the tolerances provided for therein
that do not comply with the weight requirements
12under sub. (1)
