AJR52,1,2 1To amend section 1 of article X of the constitution; relating to: appointment of the
2state superintendent of public instruction (first consideration).
Analysis by the Legislative Reference Bureau
This constitutional amendment, proposed to the 1995 legislature on first
consideration, provides that the superintendent of public instruction, instead of
being elected, will be nominated by the governor, and with the advice and consent
of the senate appointed, to serve at the pleasure of the governor.
As a constitutional amendment, the proposal requires adoption by 2 successive
legislatures, and ratification by the people, before it can become effective.
AJR52,1,3 3Resolved by the assembly, the Senate concurring, That:
AJR52, s. 1 4Section 1. Section 1 of article X of the constitution is amended to read:
AJR52,2,25 [Article X] Section 1. The supervision of public instruction shall be vested in a
6state superintendent and such other officers as the legislature shall direct; and their
7qualifications, powers, duties and compensation shall be prescribed by law. The
8state superintendent shall be chosen nominated by the qualified electors of the state
9at the same time and in the same manner as members of the supreme court, and shall
10hold office for 4 years from the succeeding first Monday in July
governor, and with
11the advice and consent of the senate appointed, to serve at the pleasure of the

. The term of office, time and manner of electing or appointing all other
2officers of supervision of public instruction shall be fixed by law.
AJR52,2,5 3Be it further resolved, That this proposed amendment be referred to the
4legislature to be chosen at the next general election and that it be published for 3
5months previous to the time of holding such election.
