AJR53,1,2 1To create section 25 of article I of the constitution; relating to: the right to keep and
2bear arms (first consideration).
Analysis by the Legislative Reference Bureau
This constitutional amendment, proposed to the 1995 legislature on first
consideration, creates a new section of article I of the state constitution. Article I
contains the state constitution's declaration of rights. The new section of article I
created by this constitutional amendment declares that: "Every individual, except
an individual restricted in accordance with federal law, has the right to keep and bear
arms for any lawful purpose including for security or defense, for hunting and for
recreational use, but the manner of bearing arms may be regulated as authorized by
the legislature by law."
Currently, the state constitution does not guarantee a right to keep and bear
arms.
As a constitutional amendment, the proposal requires adoption by 2 successive
legislatures, and ratification by the people, before it can become effective.
AJR53,1,3 3Resolved by the assembly, the Senate concurring, That:
AJR53, s. 1 4Section 1. Section 25 of article I of the constitution is created to read:
AJR53,2,25 [Article I] Section 25. Every individual, except an individual restricted in
6accordance with federal law, has the right to keep and bear arms for any lawful

1purpose including for security or defense, for hunting and for recreational use, but
2the manner of bearing arms may be regulated as authorized by the legislature by law.
AJR53, s. 2 3Section 2. Numbering of new section. The new section "25" of article I of the
4constitution created in this joint resolution shall be designated by the next higher
5open whole section number in that article if, prior to or simultaneously with the
6ratification by the people of the amendment proposed in this joint resolution, any
7other ratified amendment has created a "section 25" of article I of the constitution
8of this state. If several joint resolutions simultaneously create a section 25 of article
9I, the chief of the legislative reference bureau shall determine the sequence and the
10numbering.
AJR53,2,13 11Be it further resolved, That this proposed amendment be referred to the
12legislature to be chosen at the next general election and that it be published for 3
13months previous to the time of holding such election.
