AR21,1,2 1Relating to: memorializing Congress to amend the internal revenue code to allow
2intrafamily transfers of property under the first-time farmer bond program.
AR21,1,53 Whereas, the federal government allows first-time farmers to use proceeds of
4federally tax-exempt industrial revenue bonds to purchase their first farming
5operations; and
AR21,1,86 Whereas, the state of Wisconsin in 1994 enacted legislation authorizing the
7Wisconsin Housing and Economic Development Authority to issue bonds for that
8purpose; and
AR21,1,109 Whereas, the U.S. internal revenue code does not allow proceeds of those bonds
10to be used to finance the transfer of property between family members; and
AR21,1,1311 Whereas, the sale of land, buildings and equipment from one family member
12to another is a cornerstone of the family farming tradition in Wisconsin and in the
13nation; and
AR21,1,1514 Whereas, the internal revenue code provision arbitrarily and without purpose
15discourages the preservation of the family farm; and

1Whereas, it is in the economic and social interests of the state of Wisconsin that
2the internal revenue code be amended to preserve family farming for this and future
3generations; now, therefore, be it
AR21,2,6 4Resolved by the assembly, That the assembly of the state of Wisconsin urges
5the President and Congress to amend the internal revenue code to allow intrafamily
6transfers of property under first-time farmer bond program; and, be it further
AR21,2,10 7Resolved, That the assembly chief clerk shall provide a copy of this resolution
8to the President of the United States, to each member of the Wisconsin congressional
9delegation and to each member of the U.S. Senate and House agriculture
10committees.
