2of the statutes; relating to: the prohibition on burning yard waste without

Current law generally prohibits the burning of yard waste without energy
recovery in a solid waste facility in this state. Yard waste consists of leaves, grass
clippings, yard and garden debris and brush, including clean woody vegetative
material no greater than 6 inches in diameter. Current law authorizes the
department of natural resources (DNR) to grant waivers to the prohibition on
burning yard waste to allow the burning of brush or other clean woody vegetative
material no greater than 6 inches in diameter at wood burning facilities licensed by
DNR.
This draft specifies that the prohibition on burning yard waste without energy
recovery does not apply to the burning of brush or other clean woody vegetative
material no greater than 6 inches in diameter at a wood burning facility that is
licensed or permitted by DNR.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB191, s. 1 4Section 1. 159.07 (2) of the statutes is amended to read:
SB191,2,55 159.07 (2) Yard waste. Beginning on January 3, 1993, no person may dispose
6of yard waste in a solid waste disposal facility, except in a land spreading facility

1approved in accordance with ss. 144.43 to 144.47, or burn yard waste without energy
2recovery in a solid waste facility in this state, except that this prohibition does not
3apply to the burning of brush or other clean woody vegetative material that is no
4greater than 6 inches in diameter at a wood burning facility that is licensed or
5permitted under ch. 144
