SB58,1,3 1An Act to amend 144.405 (5) (c) and (d); and to create 144.405 (5) (am) of the
2statutes; relating to: providing financial assistance for the costs of gasoline
3vapor recovery equipment for a school bus company.
Analysis by the Legislative Reference Bureau
Under current law, the department of natural resources (DNR) makes grants
to the owner of a gasoline station located in an area of this state where federal
standards for ozone pollution are exceeded. The grants are for a portion of the costs
of installing equipment to recover vapors released when gasoline is pumped into a
motor vehicle. This bill requires DNR to make a grant to a school bus company
located in an ozone nonattainment area for a portion of the costs of installing gasoline
vapor recovery equipment at a gasoline dispensing facility that is part of the school
bus company.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB58, s. 1 4Section 1. 144.405 (5) (am) of the statutes is created to read:
SB58,2,35 144.405 (5) (am) The department shall provide financial assistance for costs
6directly incurred after August 15, 1991, for the design, acquisition and installation
7of a vapor control system on the equipment that is used to dispense gasoline to a
8motor vehicle gasoline tank at a gasoline dispensing facility located in an ozone

1nonalignment area with a classification under 42 USC 7511 (a) of moderate or worse
2if the gasoline dispensing facility is part of a business that is engaged primarily in
3transporting children to and from school by bus.
SB58, s. 2 4Section 2. 144.405 (5) (c) and (d) of the statutes are amended to read:
SB58,2,105 144.405 (5) (c) The department shall award a grant to each applicant who
6submits a complete application under par. (b) for costs allowable under par. (a) or
7(am)
The amount of the grant may not exceed 95% of the first $25,000 in costs and
890% of the next $15,000 in costs incurred by the applicant. If the department
9promulgates a rule under par. (e), it shall determine the costs based upon the rule
10promulgated under par. (e)
SB58,2,1311 (d) The department may not award a grant under this subsection after June
1230, 1995, or the day after publication of the 1995-97 biennial budget act, whichever
13is later, except that this paragraph does not apply to a grant under par. (am).
