AB194,1,2 1An Act to amend 120.10 (10m) of the statutes; relating to: the school capital
2expansion fund.
Analysis by the Legislative Reference Bureau
Under current law, a school district is authorized to vote a tax to create a fund
for the purpose of financing all current and future capital expenditures relating to
buildings and sites. All money raised by this tax must be deposited by the school
district treasurer in a segregated fund called the school capital expansion fund. The
money of the school capital expansion fund in a common school district or union high
school district may not be used for any other purpose or be transferred to any other
fund unless a majority of the school district's electors who are present at the annual
school district meeting vote to do so and only if notice that the issue would be on the
agenda of the school district meeting was included in the notice of the school district
meeting. The money of the school capital expansion fund in a unified school district
may not be used for any other purpose or be transferred to any other fund unless the
school board votes to do so.
This bill provides that neither the electors of a common school district or union
high school district nor the school board of a unified school district may authorize the
use or transfer of the money in the school capital expansion fund to pay the salaries
or benefits of employes of the school district.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB194, s. 1 1Section 1. 120.10 (10m) of the statutes is amended to read:
AB194,2,122 120.10 (10m) School capital expansion fund. Vote a tax to create a fund for
3the purpose of financing all current and future capital expenditures related to
4buildings and sites. All money raised through taxation or otherwise collected
5pursuant to this subsection shall be deposited by the school district treasurer in a
6segregated fund. Such money shall not be used for any other purpose or be
7transferred to any other fund except by authorization by a majority vote of the
8electors present at a subsequent annual meeting and only if notice that the issue
9would be on the agenda was included in the notice of the subsequent annual meeting
10under s. 120.08 (1) (c). The use or transfer of the money collected pursuant to this
11subsection may not be authorized to pay the salaries or benefits of employes of the
12school district.
