AB238,1,4 1An Act to renumber 301.16 (1p); to amend 46.22 (1) (c) 2. and 302.01; and to
2create
301.16 (1r) and 301.18 (1) (by) of the statutes; relating to: the
3establishment of a medium security correctional institution for youthful
4offenders in the city of Racine.
Analysis by the Legislative Reference Bureau
Under current law, the department of corrections (DOC) is required to establish
certain correctional institutions. This bill requires DOC to establish in the city of
Racine a medium security correctional institution for persons 15 years of age or over,
but not more than 21 years of age, who have been placed in a state prison. The bill
names the facility the "Racine Youthful Offender Correctional Facility". The bill also
requires DOC to limit the number of prisoners who may be placed at the institution
to no more than 400 at any one time.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

146.22 (1) (c) 2. Subdivision 1. does not authorize the county department of
2social services to make investigations regarding admission to or release from the
3Waupun correctional institution, the Columbia correctional institution, the Racine
4correctional institution, the Racine Youthful Offender Correctional Facility, the
5correctional institution authorized under s. 301.046 (1), the correctional institution
6authorized under s. 301.048 (4) (b), the correctional institution authorized under s.
7301.16 (1n), the Oshkosh correctional institution, the Green Bay correctional
8institution, the Dodge correctional institution, the Taycheedah correctional
9institution, county houses of correction, jails, detention homes or reforestation
10camps.
AB238, s. 2 11Section 2. 301.16 (1p) of the statutes is renumbered 301.16 (1x).
AB238, s. 3 12Section 3. 301.16 (1r) of the statutes is created to read:
AB238,2,2013 301.16 (1r) In addition to the institutions under sub. (1), the department shall
14establish a medium security correctional institution for persons 15 years of age or
15over, but not more than 21 years of age, who have been placed in a state prison under
16s. 302.01. The medium security correctional institution under this subsection shall
17be known as the Racine Youthful Offender Correctional Facility and shall be located
18at the intersection of Albert Street and North Memorial Drive in the city of Racine.
19The department shall limit the number of prisoners who may be placed at the Racine
20Youthful Offender Correctional Facility to no more than 400 at any one time.

6institution at Oshkosh is named "Oshkosh Correctional Institution". The medium
7security penitentiary near Fox Lake is named "Fox Lake Correctional Institution".
8The penitentiary at Taycheedah is named "Taycheedah Correctional Institution".
9The medium security penitentiary at Plymouth is named "Kettle Moraine
10Correctional Institution". The penitentiary at the village of Sturtevant in Racine
11county is named "Racine Correctional Institution". The medium security
12penitentiary at Racine is named "Racine Youthful Offender Correctional Facility".

13The resource facility at Oshkosh is named "Wisconsin Resource Center". The
14institutions named in this section, the correctional institutions institution
15authorized under s. 301.16 (1n) or (1o), correctional institution authorized under s.
16301.046 (1), correctional institution authorized under s. 301.048 (4) (b), minimum
17security correctional institutions authorized under s. 301.13, and state-local shared
18correctional facilities when established under s. 301.14, are state prisons.
