AB259,1,3 1An Act to create 49.148 (1t) of the statutes; relating to: grants under Wisconsin
2works for terminally ill custodial parents and custodial parents of terminally
3ill children.
Analysis by the Legislative Reference Bureau
Under current law, under the Wisconsin works program (this state's
replacement program for aid to families with dependent children), an individual who
participates in a Wisconsin works employment position receives a wage or grant for
that position. Currently, there are 3 categories of employment positions under
Wisconsin works:
1. Trial jobs, under which the participant is paid an hourly wage for each hour
actually worked.
2. Community service jobs, under which the participant is paid a monthly grant
of $555, less $4.25 for every hour that the participant fails to participate in a required
activity without good cause.
3. Transitional placements, under which the participant is paid a monthly
grant of $518, less $4.25 for every hour that the participant fails to participate in a
required activity without good cause.
Current law provides that an eligible custodial parent of an infant that is 12
weeks old or less may receive a monthly grant of $555 without having to participate
in a Wisconsin works employment position.
Under this bill, a custodial parent who has a terminal illness, or who has a
dependent child with a terminal illness, and who meets the other eligibility

requirements may also receive a monthly grant of $555 without having to participate
in a Wisconsin works employment position. Under the bill, a "terminal illness" is
defined as a medical prognosis that an individual's life expectancy is less than 12
months.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB259, s. 1 1Section 1. 49.148 (1t) of the statutes is created to read:
AB259,2,32 49.148 (1t) Terminally ill custodial parent or child. (a) In this subsection,
3"terminal illness" has the meaning given in s. 50.90 (5).
AB259,2,104 (b) A custodial parent who has a terminal illness, or who has a dependent child
5with a terminal illness, and who meets the eligibility requirements of s. 49.145 (2)
6and (3) may receive a monthly grant of $555. A Wisconsin works agency may not
7require a participant under this paragraph to participate in any employment
8positions. Receipt of a grant under this paragraph does not constitute participation
9in a Wisconsin works employment position for purposes of the time limits under s.
1049.145 (2) (n) or 49.147 (3) (c), (4) (b) or (5) (b) 2.
