AB313,1,3 1An Act to create 63.385 of the statutes; relating to: procedures for a civil service
2commission in a 1st class city to certify persons with disabilities for
3appointment to certain classified service positions.

Under current law, a 1st class city (presently only Milwaukee) is required to
have a civil service commission. Among the commission's duties is the responsibility
to oversee the civil service examinations given by the city and to keep a list of eligible
persons who take the examinations for civil service positions in the city.
This bill permits the city's board of city service commissioners to prepare
without examination special lists of persons with disabilities who are eligible for civil
service positions in the city. This provision is similar to a current law that applies
to counties with a population of 500,000 or more (currently only Milwaukee County)
and certain other counties.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

163.385 Certification and appointment of persons with disabilities;
2special list of eligibles.
The board of city service commissioners may prepare
3without examination special lists of eligible persons certified as having a severe
4physical or mental impairment and as being physically and mentally capable and
5adequately trained to qualify for a position in the classified service. The names of
6persons placed on the special list shall be certified to the appointing authority in
7addition to those certified under s. 63.39. The board of city service commissioners
8shall determine that a person on the special list meets the minimum qualifications
9for a vacant position prior to certifying the person to the appointing authority for the
10position. The appointing authority may appoint a person from the special list to a
11temporary appointment for a period of 6 months. Successful demonstration of the
12ability to perform the duties of a position under a temporary appointment shall
13qualify a person for permanent appointment to the position. The board of city service
14commissioners may fix the maximum number of persons who may be appointed from
15the special list of eligibles under this section.
