AB73,1,2 1An Act to create 254.74 (1p) of the statutes; relating to: providing a waiver from
2requirements relating to meals provided by bed and breakfast establishments.

Under current law, the biennial permits issued by the department of health and
family services (DHFS) for the operation of bed and breakfast establishments
authorize those establishments to provide no meals other than breakfast and to
provide the breakfasts only to renters in the bed and breakfast establishment.
This bill authorizes DHFS to grant a bed and breakfast establishment permit
holder a waiver from the requirement relating to meals that are provided in a bed
and breakfast establishment, if DHFS determines that the public health, safety or
welfare would not be jeopardized. The waiver is effective for the period of validity
of the permit that is issued.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB73, s. 1 3Section 1. 254.74 (1p) of the statutes is created to read:
AB73,2,24 254.74 (1p) (a) The department may grant the holder of a permit for a bed and
5breakfast establishment a waiver from the requirement specified under s. 254.61 (1)

1(b) if the department determines that the public health, safety or welfare would not
2be jeopardized.
AB73,2,43 (b) A waiver granted under par. (a) is valid for the period of validity of a permit
4that is issued for the bed and breakfast establishment under s. 254.64 (1) (b).
AB73, s. 2 5Section 2. Initial applicability.
AB73,2,86 (1) Waiver for bed and breakfast establishment. This act first applies to a
7permit issued under section 254.64 (1) (b) of the statutes on the effective date of this
8subsection.
