AB789,1,3 An Act to repeal 29.092 (3) (g); and to amend 29.092 (3) (f), 29.093 (3) (c), 29.145 (1c) (intro.) and 29.145 (1c) (c) of the statutes; relating to: fishing licenses issued to disabled residents.

Analysis by the Legislative Reference Bureau

Under current law, the department of natural resources issues annual fishing licenses to state residents who have certain disabilities for a fee of $7, including the issuing fee. For veterans who are state residents and who have certain disabilities the fee is $5, including the issuing fee. The period of validity for all of these licenses is a maximum of one year, so that these license holders must apply and qualify for these licenses on an annual basis. Under current law, the fee for a regular annual resident fishing license is $12, including the issuing fee, and the maximum period of validity is one year.

This bill changes the period of validity for a fishing license issued to disabled resident or disabled resident veteran to be for as long as the licensee is a resident and his or her disability continues. Under the bill, these disabled residents are exempt from having to pay any fee for the license.

In addition, under current law, there is no fee for annual fishing licenses issued to residents of the Wisconsin Veterans Home at King. This bill makes no change in this provision.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB789, s. 1 Section 1. 29.092 (3) (f) of the statutes, as affected by 1997 Wisconsin Act 1, is amended to read:

AB789,2,5 29.092 (3) (f) Resident disabled person. The There is no fee for an annual a fishing license issued to a resident disabled person under s. 29.145 (1c) (a) or (b) is $6.25.

AB789, s. 2 Section 2. 29.092 (3) (g) of the statutes, as created by 1997 Wisconsin Act 1, is repealed.

AB789, s. 3 Section 3. 29.093 (3) (c) of the statutes is amended to read:

AB789,2,12 29.093 (3) (c) Resident disabled person fishing license. A fishing license issued before July 29, 1995, to a disabled person under s. 29.145 (1c) is valid from the date of issuance and remains valid until March 31, 1996, as long as the licensee continues to be a resident and continues to meet the requirement of s. 29.145 (1c) (a), (b) or (c).

AB789, s. 5 Section 5. 29.145 (1c) (c) of the statutes is amended to read:

AB789,2,21 29.145 (1c) (c) Produces evidence that shows that he or she is a veteran, as defined in 38 USC 101, and is receiving disability compensation benefits under 38 USC 301 to 363 1101 to 1163 for a reduction in earning capacity disability that is rated greater than 70% under 38 USC 355 1114.

AB789, s. 6 Section 6. Initial applicability.

AB789,3,3 (1) This act first applies to fishing licenses issued to disabled residents on the effective date of this subsection.
