AJR86,1,4 1To create section 26 (2) (c) of article IV and section 11 of article VIII of the
2constitution; relating to: submittal of a state budget bill or bills and a decrease
3in the salaries of members of the legislature upon failure to pass the bill or bills
4by a specified date (first consideration).

This proposed constitutional amendment, proposed to the 1997 legislature on
first consideration, requires the governor to submit a budget bill or bills providing
appropriations for the operation of state government no later than a date fixed by law
or resolution of the legislature. The proposal also provides that, if one or more budget
bills providing such appropriations have not been passed in response to the bill or
bills submitted by the governor by both houses of the legislature, in identical form,
by August 1 of any odd-numbered year, the salary of each member of the legislature
shall be decreased by the pro rata portion of the annual salary of that member
attributable to each calendar day for each such day after August 1 on which the bill
or bills have not been passed. Currently, there are no such requirements or
limitations.
A proposed constitutional amendment requires adoption by 2 successive
legislatures, and ratification by the people, before it can become effective.
AJR86,1,5 5Resolved by the assembly, the senate concurring, That:
AJR86, s. 1 6Section 1. Section 26 (2) (c) of article IV of the constitution is created to read:
AJR86,2,47 [Article IV] Section 26 (2) (c) If one or more budget bills providing
8appropriations for the operation of state government have not been passed by both

1houses of the legislature, in identical form, by August 1 of any odd-numbered year,
2the salary of each member of the legislature shall be diminished by the pro rata
3portion of the annual salary of that member attributable to each calendar day for
4each such day after August 1 on which the bill or bills have not been passed.
AJR86, s. 2 5Section 2. Section 11 of article VIII of the constitution is created to read:
AJR86,2,96 [Article VIII] Section 11. In each odd-numbered year, no later than a date fixed
7by law or resolution of the legislature, the governor shall submit to the legislature
8one or more budget bills providing appropriations for the operation of state
9government.
AJR86, s. 3 10Section 3. Numbering of new provisions. (1) The new subsection (2) (c)
11of section 26 of article IV of the constitution created in this joint resolution shall be
12designated by the next higher open whole paragraph letter in that subsection in that
13article if, before the ratification by the people of the amendment proposed in this joint
14resolution, any other ratified amendment has created a subsection (2) (c) of section
1526 of article IV of the constitution of this state. If one or more joint resolutions create
16a subsection (2) (c) of section 26 of article IV simultaneously with the ratification by
17the people of the amendment proposed in this joint resolution, the paragraphs
18created shall be lettered and placed in a sequence so that the paragraphs created by
19the joint resolution having the lowest enrolled joint resolution number have the
20letters designated in that joint resolution and the paragraphs created by the other
21joint resolutions have letters that are in the same ascending order as are the
22numbers of the enrolled joint resolutions creating the paragraphs.
AJR86,3,9 23(2) The new of section 11 of article VIII of the constitution created in this joint
24resolution shall be designated by the next higher open whole section number in that
25article if, before the ratification by the people of the amendment proposed in this joint

1resolution, any other ratified amendment has created a section 11 of article VIII of
2the constitution of this state. If one or more joint resolutions create a section 11 of
3article VIII simultaneously with the ratification by the people of the amendment
4proposed in this joint resolution, the sections created shall be numbered and placed
5in a sequence so that the sections created by the joint resolution having the lowest
6enrolled joint resolution number have the numbers designated in that joint
7resolution and the sections created by the other joint resolutions have numbers that
8are in the same ascending order as are the numbers of the enrolled joint resolutions
9creating the sections.
AJR86,3,12 10Be it further resolved, That this proposed amendment be referred to the
11legislature to be chosen at the next general election and that it be published for 3
12months previous to the time of holding such election.
