2ammonia and providing a penalty.

Current law prohibits the theft of another person's property generally. The
misappropriation of certain types of property is also specifically prohibited under
current law.
This bill prohibits the theft of anhydrous ammonia with intent to use it in the
manufacture of a controlled substance or a controlled substance analog. A person
who violates this prohibition may be fined not more than $10,000, imprisoned for not
more than two years or both.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

AB765,1,6 4943.203 Theft of anhydrous ammonia. (1) In this section, "controlled
5substance", "controlled substance analog" and "manufacture" have the meanings
6given in s. 961.01.

1(2) Any person who intentionally takes and carries away, uses, conceals or
2retains possession of anhydrous ammonia belonging to another without the other's
3consent, with intent to deprive the owner permanently of possession of the
4anhydrous ammonia and with intent to use the anhydrous ammonia in the
5manufacture of a controlled substance or a controlled substance analog is guilty of
6a Class E felony.
