AB835,1,3 1An Act to create 46.40 (10) of the statutes; relating to: creating a program to
2assist American Indian tribes and bands in developing their capacity to provide
3child welfare services and making an appropriation.
Analysis by the Legislative Reference Bureau
Under current state law, the department of health and family services (DHFS)
distributes general purpose revenues (GPR) and federal revenues (FED), as
community aids, to county departments of human services or social services to
provide various social services, including child welfare services. Under current
federal law, the Indian Child Welfare Act authorizes American Indian tribes to
provide child welfare services for American Indian children. This bill directs DHFS
to expend not more than $85,000 in GPR in each fiscal year, beginning with the
2000-01 fiscal year, as community aids, to administer and oversee a program to
assist federally recognized American Indian tribes and bands in this state in
developing their capacity to provide child welfare services. The bill also allocates
$20,000 in new GPR and $7,000 in FED to fund a .5 full-time equivalent position for
the purpose of administering and overseeing that program.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 46.40 (10) of the statutes is created to read:
AB835,2,62 46.40 (10) Capacity building for tribal child welfare services. The
3department shall expend not more than $85,000 from the appropriation under s.
420.435 (7) (b) in each fiscal year to administer and oversee a program to assist
5federally recognized American Indian tribes and bands in this state in developing the
6capacity of the tribes and bands to provide child welfare services.
AB835, s. 2 7Section 2. Nonstatutory provisions; health and family services.
AB835,2,138 (1) Capacity building for tribal child welfare services. The authorized FTE
9positions for the department of health and family services are increased by .13 FED
10position, to be funded from the appropriation under section 20.435 (3) (n) of the
11statutes, for the purpose of administering and overseeing a program to assist
12federally recognized American Indian tribes and bands in developing the capacity of
13the tribes and bands to provide child welfare services.
AB835, s. 3 14Section 3. Appropriation changes.
AB835,2,2215 (1) Capacity building for tribal child welfare services. In the schedule under
16section 20.005 (3) of the statutes for the appropriation to the department of health
17and family services under section 20.435 (8) (a) of the statutes, as affected by the acts
18of 1999, the dollar amount is increased by $20,000 for fiscal year 2000-01 to increase
19the authorized FTE positions for the department by .37 GPR position for the purpose
20of administering and overseeing a program to assist federally recognized American
21Indian tribes and bands in this state in developing the capacity of the tribes and
22bands to provide child welfare services.

1(1) Capacity building for tribal child welfare services. This act takes effect
2on July 1, 2000, or on the day after publication, whichever is later.
