AB891,1,4 An Act to repeal 16.54 (11m), 20.370 (5) (dd) and 20.370 (5) (ds); to amend 20.370 (5) (bx); and to create 20.370 (5) (dd), 20.370 (5) (ds) and 59.25 (3) (rm) of the statutes; relating to: distribution of national forest income payments from the federal government and making appropriations.

Analysis by the Legislative Reference Bureau

Under current law, all money received by the state from receipts on national forest lands must be distributed to school districts in accordance with the number of acres of national forest land located within the school district boundaries. This requirement was imposed by 1999 Wisconsin Act 9 (the biennial budget bill). Before the enactment of 1999 Wisconsin Act 9, all money received by the state from receipts on national forest lands was required to be distributed to towns in accordance with the number of acres of national forest land located within the town boundaries. Any town that received any of these moneys was required to expend at least 50% of the moneys on public roads in the town. This bill restores the law to the way it was before the enactment of 1999 Wisconsin Act 9.

In addition, the bill requires the secretary of natural resources to make a one-time distribution of $1,805,800 to school districts that contain national forest lands within their boundaries. Of these moneys, $900,000 is taken from the conservation fund and $905,800 is taken from the general fund. The distribution to each school district must reflect the proportion of national forest acreage located within the school district.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB891, s. 1 Section 1. 16.54 (11m) of the statutes, as created by 1999 Wisconsin Act 9, is repealed.

AB891, s. 2 Section 2. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert the following amounts for the purposes indicated: - See PDF for table

AB891, s. 3 Section 3. 20.370 (5) (bx) of the statutes, as affected by 1999 Wisconsin Act 9, is amended to read:

AB891,2,13 20.370 (5) (bx) Resource aids — national forest income aids. All moneys received from the U.S. government for allotments to school districts counties containing national forest lands, and designated for the benefit of public roads in such counties, shall be distributed in proportion to the national forest acreage in each school district county as certified by the U.S. forest service. Such distribution shall be made annually within 60 days after receipt of the money from the federal government.

AB891, s. 4 Section 4. 20.370 (5) (dd) of the statutes is created to read:

AB891,3,4 20.370 (5) (dd) Payments to certain school districts; general fund. From the general fund, the amounts in the schedule to make the payments required under 1999 Wisconsin Act .... (this act), section 9 (1).

AB891, s. 5 Section 5. 20.370 (5) (dd) of the statutes, as created by 1999 Wisconsin Act .... (this act), is repealed.

AB891, s. 6 Section 6. 20.370 (5) (ds) of the statutes is created to read:

AB891,3,10 20.370 (5) (ds) Payments to certain school districts; conservation fund. The amounts in the schedule to make the payments required under 1999 Wisconsin Act .... (this act), section 9 (1).

AB891, s. 7 Section 7. 20.370 (5) (ds) of the statutes, as created by 1999 Wisconsin Act .... (this act), is repealed.

AB891, s. 8 Section 8 . 59.25 (3) (rm) of the statutes is created to read:

AB891,3,19 59.25 (3) (rm) If the treasurer's county receives national forest income, distribute the income to the towns in the county in which national forest lands are situated, with each town to receive such proportion of the income as the area of national forest lands in the town bears to the area of the national forest lands in the entire county. Fifty percent of the amount received by any town shall be expended by the town exclusively for the benefit of roads therein.

AB891, s. 9 Section 9 . Nonstatutory provisions.

AB891,4,5 (1) Payments to certain school districts. No later than June 30, 2000, the secretary of natural resources shall distribute $905,800 from the appropriation account under section 20.370 (5) (dd) of the statutes, as created by this act, and $900,000 from the appropriation account under section 20.370 (5) (ds) of the statutes, as created by this act, to school districts that contain national forest lands within their boundaries. The distribution to each school district shall reflect the proportion of national forest acreage located within the school district. The secretary of natural resources shall distribute the payments to school districts from the appropriation under section 20.370 (5) (ds) of the statutes, as created by this act, from the amounts in the conservation fund under section 25.29 (1) (c) of the statutes.

AB891, s. 10 Section 10. Appropriation changes.

AB891,4,11 (1) Joint committee on finance. In the schedule under section 20.005 (3) of the statutes for the appropriation to the joint committee on finance under section 20.865 (4) (a) of the statutes, as affected by the acts of 1999, the dollar amount is decreased by $405,800 for fiscal year 1999-00 to decrease funding for the purposes for which the appropriation is made.

AB891, s. 11 Section 11. Effective dates. This act takes effect on the day after publication, except as follows:

AB891,4,15 (1) Payments to certain school districts. The repeal of section 20.370 (5) (dd) and (ds) of the statutes takes effect on July 1, 2000.
