1An Act to repeal 20.865 (4) (d);
to amend 20.435 (4) (bc); and
to create 20.865
2(4) (d) of the statutes;
relating to: authorizing the joint committee on finance
3to supplement an appropriation for the badger care health care program and
4authorizing the department of health and family services to establish certain
5reimbursement rates for health care services provided under the badger care
6health care program and making an appropriation.
Analysis by the Legislative Reference Bureau
Under current law, the joint committee on finance (JCF) may supplement any
appropriation of any department, board, commission or agency with moneys that are
appropriated to JCF if JCF finds that an emergency exists, no moneys are available
in the appropriation and the legislature has authorized the purposes for which JCF
supplements the appropriation. Current law also authorizes JCF to transfer
appropriated moneys between any two appropriations, other than a sum sufficient
appropriation, or programs if JCF finds that the transfer will eliminate duplicative
functions, create more effective and efficient programs or more effectively carry out
the legislature's intent.
Also under current law, the department of health and family services (DHFS)
administers the badger care health care program. Under this program, DHFS
reimburses health care providers for health care services provided to certain
low-income families and certain low-income children who do not reside at home.
Under this bill, JCF is authorized in the 1999-2001 fiscal biennium to transfer
appropriated moneys from any general purpose revenue appropriation of a state
agency, other than a sum sufficient appropriation, to DHFS to supplement the
badger care health care program for costs of increasing enrollment and changing the
rates of reimbursement paid to health care providers if JCF finds that transferring
the moneys will eliminate duplicative functions, create more effective and efficient
programs or more effectively carry out the legislature's intent. This bill also creates
a sum sufficient supplemental appropriation for JCF to supplement in the
1999-2001 fiscal biennium the appropriation to DHFS for the badger care health
care program for costs of increasing enrollment and changing the rates of
reimbursement paid to health care providers. This bill also changes the
appropriation to DHFS for the badger care health care program from an annual
appropriation to a biennial appropriation.

1(a) The joint committee on finance may transfer in the 1999-2001 fiscal

7health care providers if the committee finds that the transfer will eliminate
8unnecessary duplication of functions, result in more efficient and effective methods
9for performing programs or more effectively carry out legislative intent, and that
10legislative intent will not be changed by the transfer.

(b) Notwithstanding paragraph (a) and sections 13.101 (3) and (4) and 20.003
12(4) of the statutes, from the appropriation under section 20.865 (4) (d) of the statutes,
13the joint committee on finance may supplement in the 1999-2001 fiscal biennium the
14appropriation to the department of health and family services under section 20.435
15(4) (bc) of the statutes to supplement the badger care health care program for costs
16of increasing enrollment and changing the rates of reimbursement paid to health
17care providers.

Effective dates. This act takes effect on the day after publication,
19except as follows:
