SB12,1,3 1An Act to amend 40.03 (2) (g); and to create 40.82 (3) and 230.04 (16) of the
2statutes; relating to: prohibiting the inclusion of an individual's social security
3number on certain documents issued or used by the state.
Analysis by the Legislative Reference Bureau
This bill does all of the following with respect to certain documents issued or
used by the state:
1. Requires the secretary of employee trust funds to ensure that the social
security number of a participant in the Wisconsin retirement system does not appear
on any account statement sent to the participant.
2. Requires the deferred compensation board to ensure that the social security
number of an individual who participates in a deferred compensation program does
not appear on any account statement sent to the individual.
3. Requires the secretary of employment relations to ensure that no state
agency require that its employees record their number of hours worked during any
part of a pay period on a form on which the employee's social security number is
printed.

an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB12, s. 1
1Section 1. 40.03 (2) (g) of the statutes is amended to read:
SB12,2,62 40.03 (2) (g) Shall submit once each year to each participant currently making
3contributions, and to any other participant upon request or as in the secretary's
4judgment is desirable, a statement of the participant's account together with
5appropriate explanatory material. The secretary shall ensure that the participant's
6social security number does not appear on the statement.
SB12, s. 2 7Section 2. 40.82 (3) of the statutes is created to read:
SB12,2,108 40.82 (3) The deferred compensation board shall ensure that any statement
9sent to employees who participate in a deferred compensation plan established
10under this subchapter does not contain the social security number of the employee.
SB12, s. 3 11Section 3. 230.04 (16) of the statutes is created to read:
SB12,2,1412 230.04 (16) The secretary shall ensure that no agency require that its
13employees record their number of hours worked during any part of a pay period on
14a form on which the employee's social security number is printed.
SB12, s. 4 15Section 4. Initial applicability.
SB12,2,1916 (1) Wisconsin retirement system. The treatment of section 40.03 (2) (g) of the
17statutes first applies to statements sent to participants in the Wisconsin retirement
18system on the first day of the 7th month beginning after the effective date of this
19subsection.
SB12,2,2320 (2) Deferred compensation program. The treatment of section 40.82 (3) of the
21statutes first applies to statements sent to individuals who participate in a deferred
22compensation plan offered under subchapter VII of chapter 40 of the statutes on the
23first day of the 7th month beginning after the effective date of this subsection.
SB12,3,224 (3) Recording of hours worked during a pay period. The treatment of section
25230.04 (16) of the statutes first applies to forms used by a state agency to record hours

1worked by an employee for the pay period closest to the first day of the 7th month
2beginning after the effective date of this subsection.
