AB191,1,2 1An Act to create 281.17 (1) (b) 3. of the statutes; relating to: requirements for
2approving high-capacity wells.

Current law prohibits a person from constructing or operating one or more wells
on one property that withdraw a total of more than 100,000 gallons of water a day
(high-capacity well) without the approval of the Department of Natural Resources
(DNR). DNR must disapprove the application for a high-capacity well or condition
its approval to ensure that the water supply of any public water utility will not be
impaired.
This bill requires DNR to disapprove the application for a high-capacity well
or condition its approval to ensure that the waters of the state will be protected.
Waters of the state consist of surface waters and groundwater.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1(1) This act first applies to applications for approvals under section 281.17 (1)
2of the statutes that are submitted on the effective date of this subsection.
