Under current law, the Department of Natural Resources (DNR) is required to
establish open and closed seasons for fish and game as well as any bag limits, size
limits, rest days, and conditions relating to the taking of fish and game that will
conserve the fish and game supply. This bill prohibits DNR from promulgating a rule
establishing a four-day deer herd control season in October during which a person
is authorized to hunt antlerless deer with a firearm or with a bow and arrow, unless
the rule requires that season to begin on the Thursday that immediately precedes
the last Friday in October.
This bill is introduced as required by s. 227.19 (5) (e), stats., in support of the
objection of the Assembly Committee on Natural Resources on November 7, 2001,
and the objection of the Joint Committee for Review of Administrative Rules on
January 10, 2002, to the issuance of a portion of clearinghouse rule 00-154 by DNR.
The portion of the proposed rule objected to provides that, if DNR establishes a
temporary open season for the hunting of deer, it must establish a four-day deer herd
control season for the hunting of antlerless deer with a firearm or with a bow and
arrow to begin on the Thursday closest to October 22.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
