AB277,1,2 1An Act to create 100.275 of the statutes; relating to: the sale, offer for sale, or
2distribution of mercury fever thermometers and providing a penalty.

Current law prohibits the sale of toys that contain elemental mercury. It also
prohibits the sale of certain batteries containing mercury. This bill prohibits a
manufacturer, wholesaler, or retailer from selling, offering for sale, or giving away
a mercury fever thermometer beginning on the first day of the seventh month after
the bill is enacted. Electronic fever thermometers that include a battery containing
mercury are generally exempt from the prohibition.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB277, s. 1 3Section 1. 100.275 of the statutes is created to read:
AB277,1,6 4100.275 Mercury fever thermometers. (1) Except as provided in sub. (2),
5no manufacturer, wholesaler, or retailer may sell, offer to sell, or give away a fever
6thermometer that contains mercury.

1(2) Subsection (1) does not apply to an electronic fever thermometer that
2includes a battery that contains mercury, if a person is not prohibited from selling
3that battery or offering that battery for sale under s. 100.27.
AB277,2,6 4(3) Any person who violates this section may be required to forfeit not more
5than $200 for each violation. Each sale, offer for sale, or gift of a thermometer in
6violation of this section constitutes a separate violation.
AB277, s. 2 7Section 2. Effective date.
AB277,2,98 (1) This act takes effect on the first day of the 7th month beginning after
9publication.
