AB45,1,3 1An Act to create 59.605 (3) (a) 3m. of the statutes; relating to: authorizing
2Marinette County to modify the question in a referendum to exceed the
3operating levy rate limit.
Analysis by the Legislative Reference Bureau
Under current law and subject to a number of exceptions, no county may impose
an operating levy at an operating levy rate that exceeds 0.001 or the operating levy
rate in 1992, whichever is greater. "Operating levy" is defined as the county purpose
levy, less the debt levy, and "operating levy rate" is defined as the total levy rate
minus the debt levy rate.
A county may exceed the limit under current law if its board adopts a resolution
stating its wish to exceed the operating levy rate limit that is otherwise applicable
and if that resolution is approved by the electors of the county in a referendum. The
limit may also be exceeded if a county increases the services that it provides by
adding responsibility for providing a service transferred to the county by another
governmental unit.
Under this bill, the referendum question to exceed the operating levy rate limit
that is otherwise applicable may be modified by Marinette County to specify what
the revenues generated by exceeding the operating levy rate limit will be used for and
requiring that such revenues be used for the purpose stated in the referendum.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB45, s. 1 1Section 1. 59.605 (3) (a) 3m. of the statutes is created to read:
AB45,2,72 59.605 (3) (a) 3m. In Marinette County the referendum questions specified in
3subd. 3. may also include a statement describing the purpose for which the extra
4revenue, which is generated by exceeding the otherwise applicable operating levy
5rate limit, is to be used. Any revenue that is so generated in Marinette County may
6be used only for the purpose specified in the referendum question, if the question has
7such a statement of purpose.
