AB78,1,2 1An Act to amend 45.49 (1) and 230.35 (4) (a) 3.; and to create 45.49 (1m) and
2230.35 (4) (a) 11. of the statutes; relating to: state government holidays.
Analysis by the Legislative Reference Bureau
Under current law, all offices of the agencies of state government are closed on
Saturdays, Sundays, and a total of nine state holidays. Among these holidays is the
last Monday in May, which is used as the day of celebration for May 30. (This day
is traditionally used to celebrate and observe Memorial Day.) This bill provides that
May 30 must be the day on which the offices of the agencies of state government are
closed to celebrate and observe Memorial Day, unless May 30 falls on a Saturday or
Sunday. If May 30 falls on a Saturday or Sunday, then the following Monday is the
day on which the offices of the agencies of state government are closed.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB78, s. 1 3Section 1. 45.49 (1) of the statutes is amended to read:
AB78,2,84 45.49 (1) The head of every department of the state government and of every
5court of the state, every superintendent or foreman on the public works of the state,

Every county officer, and the head of every department or office in any town,
2village, city, or other political subdivision, shall give a leave of absence with pay for
324 hours on the last Monday in May of each year, which shall be the day of celebration
4for May 30, to every person in the employ of the state or any county, town, village or
5city therein, who has at any time served in and been honorably discharged from the
6army, air force, coast guard, merchant marine, navy or marine corps of the United
7States. A refusal to give such leave of absence to one entitled thereto , shall constitute
8neglect of duty.
AB78, s. 2 9Section 2. 45.49 (1m) of the statutes is created to read:
AB78,2,1710 45.49 (1m) The head of every department of the state government and of every
11court of the state, and every superintendent or foreman on the public works of the
12state, shall give a leave of absence with pay for 24 hours on May 30, or the Monday
13immediately following May 30 if May 30 falls on a Saturday or Sunday, to every
14person in the employ of the state who has at any time served in and been honorably
15discharged from the army, air force, coast guard, merchant marine, navy, or marine
16corps of the United States. A refusal to give such leave of absence to one entitled
17thereto shall constitute neglect of duty.
AB78, s. 3 18Section 3. 230.35 (4) (a) 3. of the statutes is amended to read:
