AB86,1,3 1An Act to renumber and amend 118.25 (3); to amend 119.04 (1); and to create
2118.25 (3) (b) of the statutes; relating to: physical health examinations of
3pupils.
Analysis by the Legislative Reference Bureau
Under current law, in a county with a population of less than 500,000, a school
board may require periodic health examinations of pupils by physicians. This bill
allows a school board in any county to require that a pupil be examined by a
physician, but only if the school board provides a schedule of examinations to the
pupil's parent or guardian at the beginning of each school year and obtains the
written consent of the pupil's parent or guardian for a specific examination. The
school board may conduct an additional examination if it provides the pupil's parent
or guardian with a revised schedule and obtains the written consent of the pupil's
parent or guardian to conduct the additional examination.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB86, s. 1 4Section 1. 118.25 (3) of the statutes is renumbered 118.25 (3) (a) and amended
5to read:

1118.25 (3) (a) In counties having a population of less than 500,000, Subject to
2par. (b),
the school board may require periodic health examinations of pupils by
3physicians
a pupil to be periodically examined by a physician, under the supervision
4of a local health departments department and the department of health and family
5services, and. The school board may pay the cost of the examinations out of school
6district funds.
AB86, s. 2 7Section 2. 118.25 (3) (b) of the statutes is created to read:
AB86,2,188 118.25 (3) (b) Annually, before the start of the school term, a school board that
9wishes to examine a pupil under par. (a) shall provide the adult pupil or the parent
10or guardian of a minor pupil with a schedule of the number and dates of the
11examinations that the school board plans to conduct during the school year and a
12detailed description of the nature of each examination. The school board may not
13conduct any examination for which the adult pupil or the parent or guardian of a
14minor pupil has not consented in writing. The school board may conduct an
15examination in addition to those on the schedule if the school board provides the
16adult pupil or the parent or guardian of a minor pupil with a revised schedule and
17obtains the written consent of the adult pupil or the parent or guardian of a minor
18pupil to conduct the additional examination.
