2003 - 2004 LEGISLATURE
March 11, 2004 - Introduced by Representative Johnsrud, by request of
Department of Natural Resources. Referred to Committee on Natural
Resources.
AB994,1,2 1An Act to repeal 167.31 (4) (bg) 2. of the statutes; relating to: killing of wild
2animals in chronic wasting disease eradication zones.
Analysis by the Legislative Reference Bureau
Under current law, with certain exceptions, no person may carry a loaded
firearm, bow, or crossbow (weapon) in a vehicle or motorboat. Also, no person may
discharge a weapon from a vehicle.
There is an exception under current law to this prohibition that allows a state
or federal employee or agent to kill wild animals in order to control the spread of
disease in animals if the employee or agent is authorized to do so by the Department
of Natural Resources (DNR) and if he or she is hunting in an area that has been
designated by DNR as a chronic wasting disease eradication zone. There is also an
exception to this prohibition that allows a landowner, or a family member or
employee of the landowner, to shoot a wild animal from a farm tractor or other farm
vehicle if the animal is in a chronic wasting disease eradication zone.
Under current law, these exceptions sunset on June 30, 2004. This bill repeals
this sunset so that the exceptions will continue to apply after that date.
For further information see the state and local fiscal estimate, which will be
printed as an appendix to this bill.
