AB204,1,2 1An Act to repeal 15.05 (1) (c); and to amend 15.05 (1) (b) of the statutes;
2relating to: the appointment of the secretary of natural resources.
Analysis by the Legislative Reference Bureau
Under current law, the secretary of natural resources is nominated by the
governor, and with the advice and consent of the senate appointed, to serve at the
pleasure of the governor. Under this bill, the Natural Resources Board appoints the
secretary of natural resources.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB204, s. 1 3Section 1. 15.05 (1) (b) of the statutes is amended to read:
AB204,2,44 15.05 (1) (b) Except as provided in pars. (c) and par. (d), if a department is under
5the direction and supervision of a board, the board shall appoint a secretary to serve
6at the pleasure of the board outside the classified service. In such departments, the
7powers and duties of the board shall be regulatory, advisory, and policy-making, and
8not administrative. All of the administrative powers and duties of the department

1are vested in the secretary, to be administered by him or her under the direction of
2the board. The secretary, with the approval of the board, shall promulgate rules for
3administering the department and performing the duties assigned to the
4department.
AB204, s. 2 5Section 2. 15.05 (1) (c) of the statutes is repealed.
