AB729,1,2 1An Act to create 78.23 of the statutes; relating to: a temporary reduction in the
2motor vehicle fuel tax rate.

This bill reduces the rate of the motor vehicle fuel tax by 15 cents per gallon for
the 120 day period beginning on the fourteenth day after the bill's effective date. The
bill also transfers from the general fund to the transportation fund in fiscal year
2005-06 the approximate additional amount of the motor vehicle fuel tax that would
have been collected, if not for the reduction.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB729, s. 1 3Section 1. 78.23 of the statutes is created to read:
AB729,1,7 478.23 Motor vehicle fuel tax rate reduction. (1) During the 120 day period
5beginning on the 14th day after the effective date of this subsection .... [revisor
6inserts date], the rate of the tax imposed under s. 78.01 is reduced by 15 cents per
7gallon.

1(2) Suppliers, wholesaler distributors, and retail dealers shall reduce the price
2of motor vehicle fuel so that the reduction under sub. (1) is passed on to the ultimate
3consumer. Any person who violates this subsection is guilty of a Class G felony.
AB729, s. 2 4Section 2. Nonstatutory provisions.
AB729,2,125 (1) Transportation fund. There is transferred from the general fund to the
6transportation fund in fiscal year 2005-06 an amount determined by the department
7of revenue that is approximately equal to the difference between the amount of taxes
8imposed under section 78.01 of the statutes that the department collected during the
9120 days period under section 78.23 of the statutes, as created by this act, and the
10amount of taxes imposed under section 78.01 of the statutes that the department
11would have collected if the reduction under section 78.23 of the statutes, as created
12by this act, had not been in effect.
