AB231,1,3 1An Act to repeal 101.63 (1m) and 101.73 (1m); to amend 254.61 (1) (f) 2.; and
2to create 101.642 and 101.743 of the statutes; relating to: rules requiring that
3certain buildings be superinsulated.
Analysis by the Legislative Reference Bureau
Current law requires that the Department of Commerce (Commerce)
promulgate rules that require that one-family and two-family dwellings and
manufactured buildings that use electricity for space heating be superinsualted.
This bill prohibits Commerce from promulgating or enforcing such rules.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB231, s. 1 4Section 1. 101.63 (1m) of the statutes is repealed.
AB231, s. 2 5Section 2. 101.642 of the statutes is created to read:
AB231,1,8 6101.642 Certain rules prohibited. The department may not promulgate or
7enforce a rule that requires that any one-family or 2-family dwelling that uses
8electricity for space heating be superinsulated.

1Section 3. 101.73 (1m) of the statutes is repealed.
AB231, s. 4 2Section 4. 101.743 of the statutes is created to read:

4enforce a rule that requires any manufactured building that uses electricity for space
5heating to be superinsulated.
AB231, s. 5 6Section 5. 254.61 (1) (f) 2. of the statutes is amended to read:
AB231,2,117 254.61 (1) (f) 2. A structural addition, made to a structure that was originally
8constructed at least 50 years before an initial or renewal application for a permit
9under s. 254.64 (1) (b) is made and for which no use other than as a bed and breakfast
10establishment is proposed. The structural addition under this subdivision shall
11comply with the rules under s. 101.63 (1) and (1m).
