AB99,1,3 1An Act to amend 118.33 (1) (a) (intro.); and to create 118.33 (1) (e) of the
2statutes; relating to: granting a high school diploma to a foreign exchange
3student.
Analysis by the Legislative Reference Bureau
Under current law, with limited exceptions, a school board may not grant a high
school diploma to a pupil who has not satisfied minimum course work and
attendance requirements established for the high school grades. This bill permits
a school board to award a high school diploma to a foreign exchange student where
the school board determines that the foreign exchange student has satisfied course
work and attendance criteria established by the school board.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB99, s. 1 4Section 1. 118.33 (1) (a) (intro.) of the statutes is amended to read:
AB99,1,65 118.33 (1) (a) (intro.) Except as provided in par. pars. (d) and (e), a school board
6may not grant a high school diploma to any pupil unless the pupil has earned:
AB99, s. 2 7Section 2. 118.33 (1) (e) of the statutes is created to read:

1118.33 (1) (e) 1. In this paragraph, "foreign exchange student" means a pupil
2who has temporarily entered the United States on a nonimmigrant visa for the
3purpose of participating in an educational or cultural exchange and who is enrolled
4in a course of study in grade 11 or 12. "Foreign exchange student" does not include
5foreign nationals visiting the United States for other purposes or with one or both
6parents.
AB99,2,137 2. A school board may grant a high school diploma to a foreign exchange student
8enrolled in the school district who has not satisfied the requirements of pars. (a) and
9(b) if the school board determines that the foreign exchange student has
10demonstrated a level of proficiency in the subjects listed in par. (a) equivalent to that
11which he or she would have obtained if he or she had satisfied the requirements
12under par. (a) and has complied with the requirements of par. (b) during the grade
13in which the pupil was enrolled in the school district.
