AB499,1,3 1An Act to amend 301.068 (1) and 301.068 (6); and to create 20.410 (1) (de) and
220.410 (1) (dm) of the statutes; relating to: community supervision services in
3the Department of Corrections.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
Joint Legislative Council prefatory note: This bill was prepared for the Joint
Legislative Council's Special Committee on Justice Reinvestment Initiative Oversight.
This bill creates the following biennial general purpose revenue (GPR)
appropriations for the Department of Corrections (DOC) to provide the following:
1. Eight million dollars for mental health services for severely mentally ill persons
who are on parole or extended supervision and are at high risk of reoffending.
2. Twelve million dollars for a transitional employment program for persons who
are on parole or extended supervision, are unemployed, and are at high risk of
reoffending.
Under 2009 Wisconsin Act 28, DOC is required, through community services, to
reduce recidivism and to report annually to the governor, the legislature, and the courts

on progress toward reducing recidivism. This bill requires DOC to reduce recidivism by
25 percent between fiscal year 2007-08 and fiscal year 2010-11 and to include in its
annual reports submitted to the governor, the legislature, and the courts DOC's progress
toward that goal.

6soon to be or are currently on parole or extended supervision and who are at high risk

AB499, s. 3 8Section 3. 20.410 (1) (dm) of the statutes is created to read:

10schedule to provide a transitional employment program for persons without
11employment who are soon to be or are currently on parole or extended supervision
12and who are at high risk of reoffending.
AB499, s. 4 13Section 4. 301.068 (1) of the statutes, as created by 2009 Wisconsin Act 28, is
14amended to read:

1301.068 (1) The department shall establish community services that have the
2goals of increasing public safety, reducing the risk that offenders on community
3supervision will reoffend, and reducing by 25 percent between the fiscal years
42007-08 and
2010-11 the recidivism rate of persons who are on probation, parole,
5or extended supervision following a felony conviction. In establishing community
6services under this section, the department shall consider the capacity of existing
7services and any needs that are not met by existing services.
AB499, s. 5 8Section 5. 301.068 (6) of the statutes, as created by 2009 Wisconsin Act 28, is
9amended to read:
AB499,3,1710 301.068 (6) The department shall annually submit a report to the governor, the
11chief clerk of each house of the legislature for distribution to the appropriate
12standing committees under s. 13.172 (3), and the director of state courts. The report
13shall set forth the scope of the community services established under sub. (1); the
14numbers of arrests of, convictions of, and prison sentences imposed on offenders
15receiving the community services under this section; and the progress toward the 25
16percent
recidivism reduction goal under sub. (1) and any adjustment that will be
17made to reach that goal
