AB763,1,2 An Act to amend 254.61 (1) (b), 254.61 (5) (d) and 254.74 (1p) (a) (intro.) of the statutes; relating to: meals that a bed and breakfast establishment may serve.

Analysis by the Legislative Reference Bureau

Under current law, a bed and breakfast establishment must be licensed to operate in Wisconsin. A bed and breakfast establishment is defined, in part, as a place of lodging that has eight or fewer rooms for rent, is the owner's personal residence, provides no meals other than breakfast, and provides breakfast only to guests. A bed and breakfast is not required to have a restaurant license to prepare and serve breakfast to its guests.

This bill provides that a bed and breakfast may serve any meal to its guests and is not required to have a restaurant license to prepare and serve the meals to its guests.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB763, s. 1 Section 1. 254.61 (1) (b) of the statutes is amended to read:

AB763,1,5 254.61 (1) (b) Provides no meals other than breakfast and provides the breakfast only to renters of the place;

AB763, s. 2 Section 2. 254.61 (5) (d) of the statutes is amended to read:

AB763,2,2 254.61 (5) (d) Any bed and breakfast establishment that serves breakfasts only to its lodgers.

AB763, s. 3 Section 3. 254.74 (1p) (a) (intro.) of the statutes is amended to read:

AB763,2,8 254.74 (1p) (a) (intro.) The department may grant the holder of a permit for a bed and breakfast establishment a waiver from the requirement specified under s. 254.61 (1) (b) to allow the holder of a permit for a bed and breakfast establishment to serve breakfast meals to other tourists or transients if all of the following conditions are met:
