287.07 (4m) (b) (intro.) and 1.; and to create 287.07
3(4m) (bm) of the statutes; relating to: the disposal of oil absorbent materials.
Analysis by the Legislative Reference Bureau
Current law prohibits the disposal of certain materials in solid waste disposal
facilities, such as landfills. The law prohibits the disposal of oil absorbent materials
that contain waste oil in a solid waste disposal facility, except that the prohibition
does not apply to the disposal of less than one gallon of oil absorbent materials that
contain waste oil resulting from a nonroutine spill.
This bill replaces the general prohibition on disposing of oil absorbent materials
that contain waste oil in a solid waste disposal facility with a narrower prohibition.
Under this bill, a person may not dispose of oil absorbent materials that contain
waste oil in a solid waste disposal facility unless free-flowing oil has been drained
from the materials and the materials are not hazardous waste.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1287.07 (4m) (b) Beginning on January 1, 2011, no person may do any of the
2following: 1. Dispose
dispose of a used oil filter in a solid waste disposal facility.
AB383, s. 2 3Section 2. 287.07 (4m) (b) 2. of the statutes is repealed.
AB383, s. 3 4Section 3. 287.07 (4m) (bm) of the statutes is created to read:
AB383,2,75 287.07 (4m) (bm) Beginning on the effective date of this paragraph .... [LRB
6inserts date], no person may dispose of oil absorbent materials containing waste oil
7in a solid waste disposal facility unless all of the following apply:
AB383,2,98 1. Free-flowing waste oil is drained or other action is taken to minimize the
9amount of free-flowing waste oil in the absorbent materials.
AB383,2,1110 2. The oil absorbent materials are not hazardous waste, as defined in s. 289.01
11(12).
AB383, s. 4 12Section 4. 287.07 (4m) (c) of the statutes is repealed.
