SB106,1,2 1An Act to create 946.125 and 971.19 (13) of the statutes; relating to: absence
2without leave from a legislative session and providing a penalty.
Analysis by the Legislative Reference Bureau
Under this bill, a legislator who is intentionally absent without leave for three
consecutive days on which a roll call vote is taken during a biennial legislative
session is subject to a fine of $500 per day. Under the bill, venue for prosecuting this
crime is any county that the legislator represents at the time he or she is absent
without leave.
Because this bill creates a new crime or revises a penalty for an existing crime,
the Joint Review Committee on Criminal Penalties may be requested to prepare a
report concerning the proposed penalty and the costs or savings that are likely to
result if the bill is enacted.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB106, s. 1 3Section 1. 946.125 of the statutes is created to read:
SB106,2,2 4946.125 Absence without leave. Any legislator who is intentionally absent
5without leave for at least 3 consecutive days on which a roll call vote is taken during

1a biennial legislative session shall be fined $500 per day that he or she is
2intentionally absent without leave.
SB106, s. 2 3Section 2. 971.19 (13) of the statutes is created to read:
SB106,2,64 971.19 (13) Notwithstanding sub. (12) or s. 971.223, in an action under s.
5946.125, the defendant shall be tried in a circuit court in the district he or she
6represents as a legislator at the time of the alleged violation of s. 946.125.
