AB42,1,2 1An Act to create 119.16 (15) of the statutes; relating to: prohibiting the
2Milwaukee Public Schools from imposing residency requirements on teachers.

This bill prohibits the Milwaukee Public Schools from requiring, as a condition
of employment, that a teacher reside within the school district. The bill defines
"teacher" as any person whose employment by a school district requires that he or
she hold a license or permit issued by the state superintendent of public instruction.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB42,1 3Section 1. 119.16 (15) of the statutes is created to read:
AB42,1,64 119.16 (15) Residency requirements. (a) In this subsection, "teacher" means
5any person holding a license or permit issued by the state superintendent whose
6employment by a school district requires that he or she hold that license or permit.
AB42,1,87 (b) The board may not require, as a condition of employment, that a teacher
8reside within the school district.

1Section 2. Initial applicability.
AB42,2,42 (1) This act first applies to teachers covered by a collective bargaining
3agreement that is in effect on the effective date of this subsection upon the
4expiration, extension, renewal, or modification of the agreement.
AB42,3 5Section 3. Effective date.
AB42,2,76 (1) This act takes effect on July 1, 2013, or on the day after publication,
7whichever is later.
