SB403,1,2 An Act to amend 45.51 (2) (b) 5. of the statutes; relating to: care needs provided by veterans homes.

Analysis by the Legislative Reference Bureau

Under current law, the Department of Veterans Affairs (DVA) may admit to a veterans home a person who is a veteran and who meets certain other eligibility requirements. One of those requirements is that the person has care needs that the veterans home is able to provide.

The statutory provision as to this requirement that was in effect prior to the enactment of 2013 Wisconsin Act 20 (Act 20), the biennial budget act, specifically listed chronic alcoholism, drug addiction, psychosis, and active tuberculosis as such care needs. Act 20 removed this list from the statutory provision and this bill restores the list.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB403,1 Section 1. 45.51 (2) (b) 5. of the statutes, as affected by 2013 Wisconsin Act 20, is amended to read:

SB403,2,3 45.51 (2) (b) 5. Has care needs that the veterans home is able to provide within the resources allocated for the care of members of the veterans home , including chronic alcoholism, drug addiction, psychosis, or active tuberculosis.
