SB118,1,3 1An Act to repeal 82.03 (2) (a) and 82.03 (2) (b); and to renumber and amend
282.03 (2) (intro.) of the statutes; relating to: limitations on town expenditures
3for certain highway purposes.
Analysis by the Legislative Reference Bureau
Under current law, the town board must provide the material and equipment
needed to construct and maintain the highways under the town's jurisdiction. Also
under current law, the total sum spent for these purposes in any year may not exceed
the product of $5,000 multiplied by the miles of highway under the town's
jurisdiction. This limit may be exceeded only if exceeding the limit is authorized by
the town meeting or by referendum at a town election.
Under this bill the limit on town expenditures for material and equipment for
construction and maintenance of highways is eliminated.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

5amended to read:

182.03 (2) Funding and equipment. The town board shall provide machinery,
2implements, material, and equipment needed to construct, maintain, and repair the
3highways and bridges under the town's jurisdiction, and for those purposes may
4acquire by purchase or by condemnation under ch. 32 stone, gravel, sand, clay, earth,
5gravel pits, stone quarries, and interests in land under s. 83.07. The total sum spent
6under this subsection in any year for construction, maintenance, and repair of
7highways and bridges may not exceed the product of $5,000 multiplied by the miles
8of highway under the jurisdiction of the town measured by the most recent highway
9mileage for the town, as determined under s. 86.302, unless one of the following
10occurs:
