SB289,1,5 1An Act to repeal 29.024 (6) (am), 29.182 (7), 29.184 (9), 29.301 (3), 29.561, 29.563
2(14) (bn) and 29.563 (14) (c) 5.; and to amend 29.024 (6) (b), 29.024 (6) (d),
329.024 (7), 29.171 (3) (a), 29.171 (3) (b), 29.172 (3), 29.173 (3), 29.182 (4) (g),
429.184 (6g) (c), 29.211 (3), 29.216 (3) (title) and (a), 29.216 (3) (b), 29.217 (3),
529.231 (4) and 29.235 (4) of the statutes; relating to: back tag requirements.
Analysis by the Legislative Reference Bureau
Under current law, when the Department of Natural Resources (DNR) issues
a person an archer hunting license, a deer hunting license, a bear hunting license,
an elk hunting license, a sports license, or a conservation patron license, DNR also
issues a back tag to be attached to the person's outermost garment when that person
is hunting as authorized by the license. This bill eliminates the requirement that
DNR issue a back tag with any of these licenses and the requirement that the licensee
attach a back tag to any garment while hunting.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB289,1 6Section 1. 29.024 (6) (am) of the statutes is repealed.

1Section 2. 29.024 (6) (b) of the statutes is amended to read:
SB289,2,32 29.024 (6) (b) The clerk of each county appointed under par. (a) 2. or (am) 2. may
3accept the appointment.
SB289,3 4Section 3. 29.024 (6) (d) of the statutes is amended to read:
SB289,2,65 29.024 (6) (d) The department may promulgate rules regulating the activities
6of persons appointed under pars. par. (a) 2., 3., and 4. and (am) 2. and 3.
SB289,4 7Section 4. 29.024 (7) of the statutes is amended to read:
SB289,2,218 29.024 (7) Duplicates. If any license, permit, certificate, or card is lost, the
9person to whom the license, permit, certificate, or card was issued may apply to the
10department for a duplicate by submitting an affidavit proving loss. The department
11may accept information in a form other than an affidavit. The department shall
12make an inquiry and investigation as it considers necessary. If the department is
13satisfied that the loss has been proven, the department may issue a duplicate license,
14permit, certificate, or card to the applicant. Back tags and other tags Tags issued
15with a license, permit, certificate, or card are parts of the license, permit, certificate,
16or card and loss of any part is considered to be loss of the entire license, permit,
17certificate, or card. Upon applying for a duplicate license, permit, certificate, or card,
18the applicant shall surrender all parts of the original remaining in his or her
19possession to the department. No duplicate stamp may be issued and if a stamp is
20lost, the person to whom it was issued is required to apply for and pay the regular
21fee in order to receive a new stamp.

15shall transfer the license awarded under par. (f) only to a person who is qualified to
16receive a resident elk hunting license and shall transfer to that person the carcass
17tag and back tag that was issued by the department to the organization under subs.
18sub. (6) and (7).
SB289,10 19Section 10. 29.182 (7) of the statutes is repealed.
SB289,11 20Section 11. 29.184 (6g) (c) of the statutes is amended to read:
SB289,4,321 29.184 (6g) (c) The organization known as the Wisconsin Bear Hunters'
22Association, Inc., shall transfer the certificate awarded under par. (b) only to persons
23who are qualified to receive a Class A bear hunting license. A person who receives
24a certificate may present that certificate to the department and request a resident
25or nonresident Class A bear hunting license. Upon receipt of the certificate and the

1appropriate required fees, the department shall issue the holder of the certificate a
2resident or nonresident Class A bear hunting license and the carcass tag and back
3tag
under subs. sub. (8) and (9).
SB289,12 4Section 12. 29.184 (9) of the statutes is repealed.
SB289,13 5Section 13. 29.211 (3) of the statutes is amended to read:
SB289,4,76 29.211 (3) Deer tag and back tag. The department shall issue to each person
7who is issued a nonresident deer hunting license a deer tag and a back tag.
