SB460,1,2 1An Act to create 440.26 (3g) of the statutes; relating to: continuing education
2requirements for private detectives and granting rule-making authority.

This bill requires an individual who holds a private detective license issued by
the Department of Safety and Professional Services (DSPS), at the time that he or
she applies for a renewal of his or her license, to submit evidence satisfactory to DSPS
that he or she has completed at least 7.5 hours of continuing education in each of the
one-year periods within the last licensure period in courses that satisfy standards
established by DSPS by rule, except that the requirement does not apply with respect
to an initial renewal of a private detective license. The bill requires DSPS to
promulgate rules establishing standards for continuing education courses required
under the bill, which must require that courses contribute to the applicant's
professional competence as a private detective. DSPS may identify sponsors of
continuing education programs that have the presumption of satisfying those
standards, and may conduct audits of licensees for assessing compliance with the
continuing education requirements under the bill.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 440.26 (3g) of the statutes is created to read:
SB460,2,102 440.26 (3g) Continuing education requirements for private detectives. (a)
3An individual who holds a private detective license shall, at the time that he or she
4applies for a renewal of his or her license, submit evidence satisfactory to the
5department that he or she has completed at least 7.5 hours of continuing education
6in each of the one-year periods within the 2-year licensure period prior to the
7renewal date in courses that satisfy the standards established by the department
8under par. (b). The requirement under this paragraph does not apply to an applicant
9for renewal of a license that expires on the first renewal date after the date on which
10the department initially granted the license.
SB460,2,1611 (b) The department shall promulgate rules establishing standards for
12continuing education courses required under this subsection, which shall require
13that courses contribute to the applicant's professional competence as a private
14detective. The department may identify sponsors of continuing education programs
15that have the presumption of satisfying the standards established under this
16paragraph.
SB460,2,1817 (c) The department may conduct audits of licensees for assessing compliance
18with the continuing education requirements under this subsection.
SB460,2 19Section 2. Initial applicability.
SB460,2,2120 (1) This act first applies to a renewal of a license for the September 1, 2018,
21renewal date.
SB460,3 22Section 3. Effective date.
SB460,2,2423 (1) This act takes effect on September 2, 2016, or on the day after publication,
24whichever is later.
