SB86,1,6 An Act to amend 15.407 (10) (title), 15.407 (10) (a) (intro.), 15.407 (18) (title), 15.407 (18) (a) (intro.), 101.023, 101.62 (title), 101.62 (1), 101.62 (2), 101.62 (3), 101.62 (4), 101.63 (10), 101.64 (3), 101.72 and 101.74 (3) of the statutes; relating to: renaming the Dwelling Code Council the Uniform Dwelling Code Council and renaming the Building Code Council the Commercial Building Code Council.

Analysis by the Legislative Reference Bureau

Under current law, the Dwelling Code Council in the Department of Safety and Professional Services (DSPS) recommends a uniform dwelling code for adoption by DSPS and makes other recommendations to DSPS concerning the regulation of one- and two-family dwellings. This bill renames that council the Uniform Dwelling Code Council.

Also under current law, the Building Code Council in DSPS advises DSPS about the rules of DSPS and other issues related to the construction, repair, and maintenance of public buildings and buildings that are places of employment. This bill renames that council the Commercial Building Code Council.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB86,1 Section 1. 15.407 (10) (title) of the statutes is amended to read:

SB86,2,2 15.407 (10) (title) Dwelling Uniform dwelling code council.

SB86,2 Section 2. 15.407 (10) (a) (intro.) of the statutes is amended to read:

SB86,2,7 15.407 (10) (a) (intro.) There is created in the department of safety and professional services, a uniform dwelling code council, consisting of 11 members appointed for staggered 2-year terms. Each member shall represent at least one of the following groups:

SB86,3 Section 3. 15.407 (18) (title) of the statutes is amended to read:

SB86,2,9 15.407 (18) (title) Building Commercial building code council.

SB86,4 Section 4. 15.407 (18) (a) (intro.) of the statutes is amended to read:

SB86,2,13 15.407 (18) (a) (intro.) There is created in the department of safety and professional services a commercial building code council consisting of the following members appointed for 3-year terms:

SB86,5 Section 5. 101.023 of the statutes is amended to read:

SB86,2,24 101.023 Building Commercial building code council duties. The uniform commercial building code council shall review the rules relating to constructing, altering, adding to, repairing, and maintaining public buildings and buildings that are places of employment. The council shall consider and make recommendations to the department pertaining to these rules and any other matters related to constructing, altering, adding to, repairing, and maintaining public buildings and buildings that are places of employment. In preparing rules under this chapter that relate to public buildings and to buildings that are places of employment, the department shall consult with the commercial building code council.

SB86,6 Section 6. 101.62 (title) of the statutes is amended to read:

SB86,3,1 101.62 (title) Dwelling Uniform dwelling code council; power.

SB86,7 Section 7. 101.62 (1) of the statutes is amended to read:

SB86,3,8 101.62 (1) The uniform dwelling code council shall review the standards and rules for one- and 2-family dwelling construction and recommend a uniform dwelling code for adoption by the department which shall include rules providing for the conservation of energy in the construction and maintenance of dwellings and for costs of specific code provisions to home buyers to be related to the benefits derived from such provisions.

SB86,8 Section 8. 101.62 (2) of the statutes is amended to read:

SB86,3,14 101.62 (2) The uniform dwelling code council shall study the need for and availability of one- and 2-family dwellings that are accessible to persons with disabilities, as defined in s. 106.50 (1m) (g), and shall make recommendations to the department for any changes to the uniform dwelling code that may be needed to ensure an adequate supply of one- and 2-family dwellings.

SB86,9 Section 9. 101.62 (3) of the statutes is amended to read:

SB86,3,19 101.62 (3) The uniform dwelling code council shall consider and make recommendations to the department pertaining to rules and any other matters related to this subchapter. The uniform dwelling code council shall recommend variances for different climate and soil conditions throughout the state.

SB86,10 Section 10. 101.62 (4) of the statutes is amended to read:

SB86,3,24 101.62 (4) The uniform dwelling code council shall prepare a report that consists of the review required under sub. (1) and the recommendations required under sub. (3) once every 6 years. The council shall complete the first report no later than July 7, 2014.

SB86,11 Section 11. 101.63 (10) of the statutes is amended to read:

SB86,4,2 101.63 (10) Assist the uniform dwelling code council in preparing the report as required under s. 101.62 (4).

SB86,12 Section 12. 101.64 (3) of the statutes is amended to read:

SB86,4,6 101.64 (3) Revise the rules under this subchapter after consultation with the uniform dwelling code council or with the contractor certification council, as appropriate.

SB86,13 Section 13. 101.72 of the statutes is amended to read:

SB86,4,16 101.72 Dwelling Uniform dwelling code council. The uniform dwelling code council shall review the standards and rules for modular homes for dwellings and recommend a statewide modular home code for adoption by the department which shall include rules providing for the conservation of energy in the construction and maintenance of dwellings. Such rules shall take into account the costs to home buyers of specific code provisions in relation to the benefits derived therefrom. Upon its own initiative or at the request of the department, the council shall consider and make recommendations to the department pertaining to rules and any other matters related to this subchapter.

SB86,14 Section 14. 101.74 (3) of the statutes is amended to read:

SB86,4,19 101.74 (3) Revise the rules under this subchapter after consultation with the uniform dwelling code council.
