AB129,1,3 1An Act to amend 230.40 (2) and 230.40 (5) of the statutes; relating to: the
2requirement that a classified service employee take a leave of absence to run
3for office.
Analysis by the Legislative Reference Bureau
This bill removes the requirement that a person employed in the classified
service who runs for a partisan political office take a leave of absence during the
campaign period for that office. The bill maintains the requirement under current
law that the person separate from the classified service if elected.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB129,1 4Section 1. 230.40 (2) of the statutes is amended to read:
AB129,2,25 230.40 (2) If a person in the classified service declares an intention to run for
6partisan political office the person shall be placed on a leave of absence for the
7duration of the election campaign and if
is elected to a partisan political office, that

shall separate from the classified service on assuming the duties and
2responsibilities of such office.
AB129,2 3Section 2. 230.40 (5) of the statutes is amended to read:
AB129,2,74 230.40 (5) Persons on leave from the classified service under subs. (2) and sub.
5(4) shall not be subject to the restrictions of sub. (1), except as they apply to the
6solicitation of assistance, subscription, or support from any person holding any
7position in the classified service.
