AB148,1,2 1An Act to create 227.135 (5) of the statutes; relating to: expiration of
2statements of scope for administrative rules.
Analysis by the Legislative Reference Bureau
Under current law, an agency must prepare a statement of the scope of any
administrative rule that it plans to promulgate that contains certain information
about the agency's proposal to promulgate the rule. This bill provides for the
expiration of a statement of scope 30 months after the date on which the statement
is published in the Wisconsin Administrative Register.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB148,1 3Section 1. 227.135 (5) of the statutes is created to read:
AB148,2,34 227.135 (5) A statement of scope shall expire on the date that is 30 months after
5the date on which it is published in the register. After a statement of scope expires,
6an agency may not submit a proposed rule based upon that statement of scope to the
7governor for approval under s. 227.185 or 227.24 (1) (e) 1g. For purposes of this

1subsection, a revised statement of scope prepared under sub. (4) shall expire on the
2date that is 30 months after the date on which the revised statement is published in
3the register.
AB148,2 4Section 2. Nonstatutory provisions.
AB148,2,85 (1) A statement of scope or revised statement of scope prepared under section
6227.135 of the statutes that was published in the Wisconsin Administrative Register
7before the date specified in Section 3 (1 ) of this act shall expire on the date that is
830 months after the effective date of this subsection.
AB148,3 9Section 3 . Initial applicability.
AB148,2,1210 (1) The treatment of section 227.135 (5) of the statutes first applies to a
11statement of scope that is published in the Wisconsin Administrative Register on the
12first Monday after publication.
