AB464,1,2 1An Act to renumber and amend 29.088 (2m); and to create 29.088 (2m) (b) of
2the statutes; relating to: the maximum height of pole traps.

This bill increases from three feet to ten feet the maximum height at which a
person may set or operate a trap or device built or used to capture birds on a pole,
post, tree stump, or any other elevated perch if the person holds a valid migratory
bird depredation permit issued by the U.S. Fish and Wildlife Service.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

4amended to read:
AB464,1,85 29.088 (2m) (a) It Except as provided in par. (b), it is unlawful to take, capture ,
6or kill or attempt to take, capture, or kill any bird by setting or operating any trap
7or device designed, built, or used to capture birds on a pole, post, tree stump, or any
8other elevated perch more than 3 feet above the ground.

1Section 2. 29.088 (2m) (b) of the statutes is created to read:
AB464,2,52 29.088 (2m) (b) A person who holds a valid migratory bird depredation permit
3issued by the U.S. fish and wildlife service under 50 CFR 21.41 that authorizes the
4trapping of birds may set or operate a trap or device described under par. (a) on an
5elevated perch no more than 10 feet above the ground.
