AB563,1,3 1An Act to amend 165.785 (1) (b) 3., 165.785 (2r) and 175.51 (title); and to create
2175.51 (3m) of the statutes; relating to: dissemination of threats against law
3enforcement.
Analysis by the Legislative Reference Bureau
The Department of Justice currently administers an integrated crime alert
network and may use the network to provide to state agencies, law enforcement, or
the public information regarding criminal activity, crime prevention, missing or
endangered persons, and certain hit-and-run incidents. This bill requires DOJ to
allow law enforcement agencies to use the network to disseminate threats against
law enforcement. The bill also requires a law enforcement agency to use the network
to disseminate the threats if an alert could help avert harm or aid in apprehending
an individual and if 1) a law enforcement officer has suffered great bodily harm or
death; 2) a law enforcement officer is missing; or 3) there is an imminent and credible
threat that an individual intends to injure or kill a law enforcement officer.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB563,1 4Section 1. 165.785 (1) (b) 3. of the statutes is amended to read:

1165.785 (1) (b) 3. The department shall ensure that a law enforcement agency
2may access the network under par. (a) to disseminate a report under s. 175.51 (2m)
3or (3m) to persons on the list maintained under sub. (2r).
AB563,2 4Section 2. 165.785 (2r) of the statutes is amended to read:
AB563,2,85 165.785 (2r) The department shall maintain a list of persons that can
6effectively broadcast or make public reports disseminated under s. 175.51 (2m) or
7(3m)
. The department shall ensure that the list includes persons engaged in
8broadcasting or outdoor advertising.
AB563,3 9Section 3. 175.51 (title) of the statutes is amended to read:
AB563,2,11 10175.51 (title) Reports of missing adults at risk and of, hit-and-run
11incidents
, and threats against law enforcement.
AB563,4 12Section 4. 175.51 (3m) of the statutes is created to read:
AB563,2,1613 175.51 (3m) A law enforcement agency shall disseminate through the
14integrated crime alert network a threat against law enforcement if the law
15enforcement agency determines that an alert could help avert harm or aid in
16apprehending a person, and that any of the following conditions is met:
AB563,2,1817 (a) A law enforcement officer has suffered great bodily harm or death in the line
18of duty.
AB563,2,2019 (b) A law enforcement officer is missing and his or her missing status is in
20connection with his or her duties.
AB563,2,2221 (c) There is an imminent and credible threat that a person intends to cause
22great bodily harm to or the death of a law enforcement officer.
