This bill defines the safe carrying capacity on a boat based solely on the
maximum allowed total weight of person, motor, gear, and other articles placed
aboard a boat and not on the number of persons allowed aboard a boat.
Current law prohibits a person from operating, and a boat owner from allowing
a person to operate, a boat that is loaded with passengers or cargo beyond its safe
carrying capacity, taking into consideration weather and other existing operating
conditions. Under current Department of Natural Resources Administrative Code,
“safe carrying capacity” is defined as either the maximum number of persons allowed
and the maximum allowed total weight of person, motor, gear, and other articles
placed aboard as displayed on the boat's capacity plate, under normal conditions, or
less than the maximum number of persons or the maximum allowed total weight of
person, motor, gear, and other articles placed aboard as displayed on a boat's capacity
plate when taking into consideration abnormal weather or other existing operating
conditions.
This bill codifies this definition of “safe carrying capacity,” but eliminates the
reference to the maximum number of persons allowed, instead basing the definition
solely on the maximum weight allowed.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
