SB208,1,4 1An Act to amend 71.08 (1) (intro.) and 71.10 (4) (i); and to create 20.835 (2) (cb)
2and 71.07 (8m) of the statutes; relating to: creating a refundable individual
3income tax credit to provide assistance to young adults and making an
4appropriation.
Analysis by the Legislative Reference Bureau
This bill creates a refundable individual income tax credit for individuals ages
18 to 21 who were either previously in foster care but aged out at age 18 or previously
designated disabled under federal law, as a minor, but lost their disability status
resulting from a redetermination at age 18. The credit that may be claimed is equal
to 125 percent of the federal earned income tax credit for an individual who has no
dependent children and may be claimed without regard to the age requirements for
the federal EITC. The bill first applies to taxable years beginning after 2017.
The bill requires the Department of Revenue to work with the Department of
Children and Families and the Department of Health Services to verify the claims
of the claimants. Because the credit is refundable, if the amount of the claim exceeds
the claimant's tax liability, DOR will refund the difference to the claimant by check.

SB208,2,32 20.835 (2) (cb) Young adult employment assistance credit. A sum sufficient to
3pay the claims approved under s. 71.07 (8m).
SB208,2 4Section 2 . 71.07 (8m) of the statutes is created to read:
SB208,2,65 71.07 (8m) Young adult employment assistance credit. (a) Definitions. In
6this subsection:
SB208,2,147 1. “Aged out” means, except as provided in ss. 48.368 and 938.368, an
8individual is discharged from out-of-home care due to termination of an order under
9s. 48.355, 48.357, 48.365, 48.427, 938.355, 938.357, or 938.365, made before the
10individual attains 18 years of age, that places or continues the placement of the
11individual in out-of-home care; termination of a voluntary
12transition-to-independent-living agreement under s. 48.366 (3) or 938.366 (3); or
13termination of a voluntary placement agreement under s. 48.63; any of which occur
14on the date of any of the following:
SB208,2,1515 a. The date that the individual attains 18 years of age.
SB208,2,2016 b. The date that the individual is granted a high school or high school
17equivalency diploma, or the date on which the individual attains 19 years of age,
18whichever occurs first, if the individual is a full-time student at a secondary school
19or its vocational or technical equivalent and is reasonably expected to complete the
20program before attaining 19 years of age.
SB208,2,2521 c. The date on which the individual is granted a high school or high school
22equivalency diploma or the date on which the individual attains 21 years of age,
23whichever occurs first, if the individual is a full-time student at a secondary school
24or its vocational or technical equivalent and if an individualized education program
25under s. 115.787 is in effect for the individual.

1d. The date that an individual who is 18 years of age or over makes a decision
2to leave out-of-home care and the order is dismissed, the voluntary
3transition-to-independent-living-agreement is terminated, or the voluntary
4placement agreement is terminated.
SB208,3,75 e. The date of termination of an order under s. 48.355, 48.357, 48.365, 48.427,
6938.355, 938.357, or 938.365, that provides for the termination one year or less after
7the date on which the order was entered.
SB208,3,88 2. “Claimant" means a young adult who files a claim under this subsection.
SB208,3,119 3. “Earned income tax credit” means the federal basic earned income credit
10under section 32 (b) (1) (A) to (C) of the Internal Revenue Code for a claimant with
11no dependent children, and without regard to the age limits under federal law.
SB208,3,1212 4. “Young adult” means an individual who meets one of the following criteria:
SB208,3,1513 a. The individual aged out of out-of-home care without achieving permanency
14in either of the 2 taxable years prior to the taxable year to which the claim relates,
15or who did so in the taxable year to which the claim relates.
SB208,3,2016 b. The individual was previously designated as disabled under the
17supplemental security income program as a minor, but who, in either of the 2 taxable
18years prior to the year to which the claim relates, or in the taxable year to which the
19claim relates, lost his or her disability status due to a disability redetermination
20using the adult disability rules when he or she reaches 18 years of age.
SB208,4,321 (b) Filing claims. Subject to the limitations provided in this subsection, a
22claimant may claim as a credit against the tax imposed under s. 71.02 or 71.08 an
23amount equal to 125 percent of the earned income tax credit in the year to which the
24claim relates, and if the allowable amount of the claim exceeds the income taxes
25otherwise due on the claimant's income, the amount of the claim not used as an offset

1against those taxes shall be certified by the department of revenue to the department
2of administration for payment to the claimant by check, share draft, or other draft
3drawn from the appropriation account under s. 20.835 (2) (cb).
SB208,4,54 (c) Limitations. 1. No credit may be claimed under this subsection by a
5part-year resident or a nonresident of this state.
SB208,4,76 2. No credit may be allowed under this subsection unless it is claimed within
7the period specified in s. 71.75 (2).
SB208,4,108 3. No credit may be allowed under this subsection for a taxable year covering
9a period of less than 12 months, except for a taxable year closed by reason of the death
10of the taxpayer.
SB208,4,1211 (d) Administration. 1. Subsection (9e) (d), to the extent that it applies to the
12credit under that subsection, applies to the credit under this subsection.
SB208,4,1413 2. The department of revenue and the department of children and families shall
14work together to verify the claims of individuals described in par. (a) 4. a.

16together to verify the claims of individuals described in par. (a) 4. b.

SB208,5,2019 (1) Young adult employment assistance credit. This act first applies to taxable
